Three Republican Federal Election Commissioners have found that unions or corporations can compel employees to campaign for political candidates in the aftermath of the Supreme Court’s Citizens United ruling. In a Statement of Reasons memorandum signed on August 21, 2012, the commissioners contend that the United Public Workers union (UPW) was within its legal right to require employees to “provide support for Hawaii Fist Congressional District candidate Colleen Hanabusa’s candidacy in a special congressional election on May 22, 2010.” The case stemmed from a complaint in wich two employees alleged that they were fired after refusing “to comply with a UPW request to sign-wave, phone bank, canvass, and contribute to Hanabusa’s campaign.” The GOP commissioners found that current law and regulations do not prohibit employers from requiring participation: UPW’s independent use of its paid workforce to campaign for a federal candidate post-Citizen’s United was not contemplated by Congress and, consequently, is not prohibited by either the Act or Commission regulations …. Requiring employees to work on independent expenditures for either the union or a non-connected political committee is not a violation of the Act or Commission regulations

Freedom Path ad In late March, a federal judge ruled that the Federal Election Commission had ignored the law and improperly allowed some outside groups to shield their donors from required disclosure. The decision ordered that secret-money groups running “ electioneering communications ” — independent ads run within 30 days of federal primaries or within 60 days of federal general elections that mention candidates but do not expressly advocate for or against them — must identify all donors contributing over $1,000 bankrolling their efforts. An appeals court refused to stay the ruling

Georgia death row inmate William Lee Hill Jr., set to be executed on Monday, has officially filed an emergency appeal with the Supreme Court. The appeal, filed yesterday, argues that Hill should not be executed because he is mentally retarded. Last week the Georgia State Board of Pardons and Parole denied both Hill’s request to commute his sentence to life in prison and his request for a 90-day stay but his execution, originally scheduled for today, was delayed because of Georgia’s decision to change the chemicals it uses in executions.

A bipartisan group of Congress members are proposing legislation to bridge the gap between the federal prohibition against medical marijuana and state-level laws that allow it. Under HR 6134, individuals who are using marijuana for medical purposes in accordance with their state’s laws will be better able to defend themselves against federal law. The bill also makes it more difficult for the federal government to seize and destroy marijuana paraphernalia.

On Tuesday, Circuit Judge David Flanagan ruled that Wisconsin’s new Republican-authored law requiring all voters to show photo identification to vote poses a “substantial burden” upon voters, and permanently barred it from taking effect. Flanagan explained that Wisconsin’s constitution bars the costly and difficult process of attaining photo identification from being an obstacle to voting
